Terms of service

The rules for using Tersa Cloud and paying for it, in plain words.

Effective October 5, 2026

Esta página aún no está traducida; se muestra en inglés.

Who these terms are with

Tersa Cloud is provided by Jean Baez, an individual doing business as Tersa (“Tersa”, “we”, “us”). These terms are an agreement between you and Tersa. By creating an account or using Tersa Cloud you agree to them; if you do not agree, do not use it.

They cover Tersa Cloud only. This website has its own privacy page.

What Tersa Cloud is

Tersa Cloud is a dictation app for Mac. Existing Windows and Linux releases remain available at their legacy download addresses. While you hold a key, the app sends your audio over an encrypted connection to Tersa’s service, which passes it to a speech-recognition provider and returns the text. When you use Polished, the text is also sent to a language-model provider that suggests edits, which are checked before they are inserted. The app then types the result into the app you were using.

Tersa’s service does not store your audio or your text. How your information is handled is set out in the privacy policy, which is part of these terms.

An early version

Tersa Cloud is in alpha: an early version. Features, limits and providers may change, and the service may be slow, interrupted or unavailable without notice. While it is in alpha there is no promise of uptime or availability, and no service credits.

We will tell you by email or in the app before a change that reduces what a paid plan includes.

Your account

  • You sign in through Clerk, our sign-in provider. Use an email address you can receive mail at, and keep your sign-in secure.
  • An account is for one person. Do not share it, sell it, or let other people use it.
  • You must be at least 16 to use Tersa Cloud, and old enough to make a binding contract where you live to buy a subscription.
  • You are responsible for what happens under your account. Tell us at [email protected] if you think someone else has used it.

Plans and payment

Free includes 15 minutes of As spoken dictation a week. Paid Pro costs $12 a month or $120 a year and includes As spoken, Clean and Polished, up to 15 hours a month. An eligible account can explicitly activate one Pro trial in Account and plan: 7 consecutive days with 60 total minutes, without a card. Its allowance does not reset. Paid and active Beta accounts cannot start a concurrent trial. The pricing page sets out what each plan includes and is part of these terms.

Payments are processed by Stripe. For Pro, Stripe is the merchant of record: you buy Pro from Stripe, through its Link service, and Stripe charges any sales tax or VAT that applies and handles the payment, the receipts and the invoices. For questions about the service itself, write to us at [email protected].

A paid Pro subscription renews automatically at the end of each month or year until you cancel. The cardless trial never converts to a paid subscription and never charges a saved card; buying Pro is a separate, explicit action. When the trial ends, your account returns to Free unless you have separately purchased Pro. You can cancel a paid subscription at any time from the app, which opens your Stripe billing page, or by writing to us at [email protected]. Paid Pro stays active until the end of the period you paid for; then your account returns to Free. Cancelling does not refund the current period, except as the refund policy says.

If we change the price of Pro, we will tell you at least 30 days before your subscription renews at the new price, and you can cancel before it applies.

If a payment fails, Stripe may retry it. A past-due or unpaid subscription does not grant paid Pro access. Your account uses any independently active trial or Beta access it still has, otherwise Free; a payment retry does not restart a trial.

Fair use and limits

Tersa Cloud is priced for people dictating as they work. These limits keep it affordable and stop it being used as something else:

  • Allowance. Free: 15 minutes of audio a week. Paid Pro: up to 15 hours of audio a month, counted over your billing month. Pro trial: 60 total minutes across its 7 days, with no calendar reset or additional Free allowance during the trial. Minutes are measured from the audio Tersa’s service receives for each dictation, to the millisecond.
  • At the limit. The app warns you at 80 % of your allowance. Free and paid Pro allow up to 60 seconds of finishing grace before the next dictation is refused until the allowance resets. Trial dictation stays within its reserved allowance; after all 60 minutes are used, no further dictation starts during the trial. Clean and Polished remain trial features until its fixed end. Your recording and available text are preserved if a final edit becomes unavailable.
  • Live dictation only. Audio has to arrive as you speak it. A dictation whose audio arrives faster than 1.5 times real time over any 5 seconds is stopped, because that is a recording being sent as a file.
  • Length. One dictation lasts at most 2 minutes on Free and 10 minutes on paid Pro or the Pro trial, subject to the remaining allowance.
  • Devices. Free allows one dictation at a time. Pro allows up to 2 at once, across your computers.
  • Rates. We limit how often an account can start dictations and request Polished edits, well above what a person dictating needs.

Acceptable use

Do not:

  • use Tersa Cloud to transcribe recordings or files, or run it as a transcription service for other people, or resell it;
  • create more than one account, or use someone else’s, to get more free minutes;
  • reach Tersa’s service other than through the Tersa Cloud app, script it, or try to get around the limits above;
  • reverse engineer, probe, overload or disrupt the service, or try to reach anyone else’s account or data;
  • record other people without the consent the law where you are requires, or use Tersa Cloud for anything unlawful, or to harass or harm anyone.

If an account breaks these rules, or its use looks automated or abusive, we may refuse its dictations, pause it while we look into it, or close it. Where we can, we will tell you why and give you a chance to respond.

Your words

What you say, and the text that comes back, are yours. You allow Tersa, and the providers named in the privacy policy, to process them only to turn your speech into text and deliver it to you. Tersa’s service does not store them, does not use them to train models, and does not sell them.

Speech recognition and language models make mistakes. Check what was inserted before you rely on it, above all for medical, legal, financial or safety-critical text.

Changes to these terms

We may update these terms. For a change that matters to you, we will tell you by email or in the app at least 30 days before it applies, and you can cancel before it does. The effective date at the top of this page shows the version that applies.

Ending your use

  • You can stop using Tersa Cloud at any time. To delete your account, write to [email protected] from the address on it. Deleting it ends any subscription, and your data is removed as the privacy policy describes.
  • We may suspend or close an account that breaks these terms, that the law requires us to close, or whose payment cannot be collected.
  • If we stop offering Tersa Cloud, we will tell you at least 30 days before, and refund the unused part of any Pro period you paid for in advance.
  • The sections on your words, no warranty, liability and governing law continue to apply after your use ends.

No warranty

Tersa Cloud is provided “as is” and “as available”. To the extent the law allows, we make no promise that it will be accurate, uninterrupted or free of errors, or that it fits a particular purpose. Nothing in these terms takes away rights you have as a consumer that the law where you live does not allow to be waived.

Liability

To the extent the law allows, Tersa is not liable for indirect, incidental, special or consequential losses, or for lost profits, revenue or data, arising from your use of Tersa Cloud. Tersa’s total liability for any claim about Tersa Cloud is limited to the amount you paid for it in the 12 months before the claim arose.

These limits do not apply to liability that the law does not allow to be limited, such as for death or personal injury caused by negligence, or for fraud.

Governing law

These terms are governed by the laws of the State of Connecticut, United States. Disputes will be decided by the courts of the State of Connecticut, United States, unless the law where you live as a consumer gives you the right to bring a claim in your own courts.
